One day after Sheila Keen-Warren's attorneys asked a judge to order the state to produce several items of evidence, including a "Clown Sighting File," prosecutors have located the allegedly lost file which may throw the trial schedule into disarray.

In a newly filed motion, defense attorney Greg Rosenfeld writes:

"On October 12, 2022, one day after the hearing, eight days before her trial, 40 months after the initial request, and 60 months after her arrest, the State informed the Defense that it found new evidence: the “clown sighting file.”

Rosenfeld and co-counsel Amy Morse had argued in a Tuesday hearing the file could contain other suspects in the 1990 murder of Marlene Warren and thus aid in her defense, but the state said it had done its due diligence, and no such file could be found.

Judge Scott Suskauer verbally denied the defense's motion to order the state to produce the file and other items the defense claimed were being withheld contrary to the law, chiding the defense for waiting until the eve of trial to make their motion.

In the new motion, Rosenfeld writes:

"The State admitted that the clown sighting file was located in, of all places, a box at the State Attorney’s Office. The State further admitted that this is the same box that contained the other crucial discovery the State produced last month, 4.5 years after Ms. Keen-Warren’s arrest."

"The State claimed that it did not see the “clown sighting file” when it initially looked through the box. The State said that the “clown sighting file” may have been mislabeled. To be clear, the folder is labeled “clown sightings.”

Rosenfeld said the file contains roughly 40 credible leads of alleged clown sightings called into the Palm Beach County Sheriff's Office after detectives put out a press release asking for any such information on the day of Warren's murder.

He said it will take the defense time to investigate those leads — and trial is scheduled to begin Oct. 21.
